What was stupid was not inserting a clause that in the event of a loan, that would not be to a club in the A league.

 But... that's what the 'Caceres clause' was there for when we made the deal.

The clause that the Phoenix were in favour of repealing, and of which steps were already being taken to remove it, before the deal took place.

Knowing this was happening, the Nix absolutely should have sought assurances that this wouldn't happen. This is either a lack of foresight from the Nix, of which Foley and AP took full advantage, or the Nix don't really care. There's no consipracy here.
