We have good relations with both organisations.

I think the reason that the Obama picture was allowed to be used was because it was in fact a drawing...

SIDE NOTE: Art work was done by Sheppard Fairey (of Obey Giant fame), as part of 'Artists for Obama' campaign run through Obama's site. Shepard or someone from the Obama Presidential campaign could sue over copyright of artwork.

Anyway, I'm just glad I got a Rory Fallon tee.

Also, How come no-one thought: He's tall, he's slick, we give his dad stick.... was a a good chant.

Big difference Term_X.

We have licensed the photo we used for the Big Bad from a photographer. So we have the right to use it.

The fact that it happens to be a picture of Rory is irrelevant. Do you think every sports star gets a payment every time a photo of them is used in a magazine, or one a poster?

And it's completely different to using the Yellow Fever or Wellington Phoenix logos. The author of those logos owns the copyright, and in the WPX case I think it's also a reg'd trade mark. And in either case you would be "passing off" under the Fair Trading Act.



I was speaking to an IP Lawyer about this issue wih the T-shirt this morning, and she said exactly the same thing. If YF have permission from the person who took the photograph (ie the copyright holder) then YF are entitled to use the image, regardless of what the subject of the image is. Therefore, Rory Fallon's agent has no recourse whatsoever to stop YF using the image, and can at best only request that they don't use it- and only rely on Yf's goodwill to not use it.

The guy that did the Obama poster has been/is in court - AP  took him to court for copyright infringement, as the poster is based directly from an agency picture. See for yourselves

Term X it is you who is taking the holyer than thou stance. It is you who should lightern up and let the people react to someting that should not have happened. It comes from a point of intent. Did YF create the shirt to libel Name Removed or show him in a derogerty way. Ans No way! Are they a profit generating entity breach copyright or commons copyright. Ans NO. Then his grab for money should be un-ashamedly be held up for what it is. Greed.

Name Removed would have had to instruct or make a decision for his agent to make the call for cash. Agents dont really make decisions themselves as it carries too much risk when things go pear shaped. The Name Removed person has family in the country and well, perhaps they are wanting a piece of the action.
