Wrong, the main screw up here is the pussy footed FFA handling of a change of licence and club ownership. Remember it was an arbitration tribunal that ruled in your favour, not the FFA who now really need to re-evaluate their own rules and procedures so that things like this are crystal clear.

Ccm didn't do their own cause any favours but I would suggest that is down to your new owner not knowing what the hell he was doing.

The PFA acted in accordance to all the information they were exposed to and so did McGlinchey. That information was wrong, who supplied it? 

The Nix might not have been totally innocent but they did act also in accordance to the same wrong information. This is not their fault as a result.

No ... this constant talk of FFA different seasons regs, whether or not the Mariners did or did not change ... is simply wrong ..

BTW the only time I have questioned Nix's management is that they accepted the advise of the PFA to easily ...

As clear as I can and am re stating this ... across world sport no player or club can benefit from a change in ownership... its there to protect mostly the players and player unions around the world in different sports have spent dollars and time to ensure this...

The PFA is affiliated across Australian sporting codes as well as many overseas Football unions... This is part of Players Union D & A one of the key reasons they exist to protect players on change of owners... Once the Mariners established very early on their contract and offered a solution the PFA should have jumped at it...

The PFA could have said we got some wrong advise early this is what it is and this is what takes place world wide ... look back at my posts and I said this case was a lay down straight forward case ... Basketball, Baseball, Cricket, Rugby, League, Handball and Football world wide have as I have always said have spent years working on change of ownerships issues and the standard is no one benefits .

However the PFA choose to rely on some information that runs totally against their D & A,  and world practise is for them to explain. 

Hand on heart not the other thing IMO both the Nix's and player have been used by the PFA ... as I said i have my reason which I may post latter ... I would add the slowness in FFA responses has not helped my guess is they wanted to protect the real reason I think this case was run.

So the letter from the FFA to the PFA advising them of the change of license holder is a figment of everyone's imagination?

The Phoenix sort legal advice and was given the same conclusion the PFA got. The advice given to the player & club was correct based on the information they were supplied by the FFA. The reason why the arbitrator ruled in CCM's favour is that the FFA supplied false information to the PFA & player.

No other sport in Australia has a ownership structure like the way the FFA have set up for the A-League. No precedent could be set by any ruling that came out of this.

They could have easily said with new information we accept our original advise was wrong... they choose to fight this for six months 

You seem committed to the ideas ... the FFA, and maybe Mariners have got it totally wrong ... further the PFA are paragons of honour who would never tell a lie... or have any other motive other than the players interest at heart... 

BTW no one is saying initial advise from FFA was right... however that often happens in business... people do not always get it right the first time.

Remember the solution the Mariners offered at the start is now in place six months latter

The PFA & player agent appear to have known nothing about the false information until the arbitration hearing. Why wasn't it given before then? 

The PFA havent been given any reason why the license transfer hasn't happened and that has implications to their other members. They really need to find out why the transfer didn't happen and see what players are still registered with NewCo and make sure none of their members were pressured into re-signing with OldCo. There are so many questions and no answers available.

If you had a contract to work for a company for a fixed term and the company changed hands and their lawyers came to you with a piece of paper to sign which they said transferred your contract to the new owners, wouldn't you assume that if you didn't sign that piece of paper you wouldn't hold a contract anymore? Or else why did they bother giving you a new piece of paper to sign? 

Edit: Unless it was an IT code of conduct policy saying employees mustn't watch porn on work computers or something that WeeMac refused to sign....

So the FFA had 6 months in which to advise CCM, the PFA, McGlinchey and his agent, and the Nix, that they had indeed given them wrongful information on which everyone acted on in good faith? 

Fuck this makes fhe FFA look even more stupid than originally thought.

This transfer might now be over but so too is the FFA credibility.  What sort of Mickey Mouse operation is it? Make the rules up as you go, don't disclose all pertinant information regarding club ownership and or transfers of players.

I thought they were meant to be a professional body, obviously I was wrong. Jesus, I just finished watching Mickey Mouse Clubhouse with my grandchildren and that made more sense than the FFA do.

Midfielder, for someone who has made so many posts on this subject and seems to have an opinion on every aspect, I'm surprised that I can't seem to find anywhere where you have addressed the issue around the change of ownership and the letter that was posted on here previously. I'm genuinely interested to hear your thoughts on that.

It's all about Successors and Assignees, and whether both parties signed to accept the contract with the new owners. Mikey didn't, so we're told. QED end of story. It's only Contract Law dressed up in football, FFS.

The good thing is we are actually able to have a reasonable debate about OPTIONS for the starting 11, and whoever you leave out, Italiano, Moss, Bonavecia, McGlinchey, Burns, Krishna, Cunningham, Boxall, Fenton, Boyd, Hicks, Doyle,... jeez, even Brockie... is going to be unlucky to have missed out, and we're going to have a bench full of blokes who could easily be starters, not a bench full of guys who are good enough to be on the bench but not good enough to start.

On the a-league show podcast Merrick confirmed that McGlinchey approached the Phoenix and not the other way around.

Of course Australians will label us as the bad guys, but it appears as though we were just as much victims as anyone else and didn't go off to try and steel the mariners player.
