Sooo what do Nix/LH actually achieve from getting this overturned? From what I understand their Capital 1 side would still be relegated and their CP side would still be safe.
Errr..So is your belief just because it doesnt effect their own league position/safety, they should have just walked away from appealing & overturning a situation they believe they were in the right about?
Edit: Without knowing what a succesful appeal would mean in terms of change of punishment eg: full/partial point reversal & future consequence to their league position I guess it was just an ongoing process before final positions determined anyway.
So as things stand I guess they "achieve" partially? winning their case eventhough their league position/safety isnt changed
Edit: Nope got it wrong. While they do end up on the same points with 17 each, the goal difference I think is actually -1 for Miramar and -21 for Lower Hutt

LHCAFC appealed the Regional Association Disciplinary Committees Decision to the New Zealand Football Disciplinary Committee (NZF DC).
The NZF DC have reviewed the appeal made by LHCAFC and have made the decision to overturn the sanctions imposed by the Competitions Administration before 22 July 2022. See below:

Capital Football have made the decision to appeal the NZF DC’s ruling to the New Zealand Football Appeals Committee. The reasons for appealing are highlighted below:
After considering the NZF DC decision and taking advice, we consider the decision to be incorrect in its interpretation of the Capital Football/Wellington Phoenix (WPX) Participation Agreement and Capital Football Playing Regulations.
Furthermore, the NZF DC was not provided with the reasons for the Regional Association Disciplinary Committee decision which was being appealed to it, and which had upheld the Competitions Administrator`s decision. Capital Football thinks this is unsatisfactory and concerning that the correct process was not followed.
In our view, the separate ground for the decision, that Capital Football`s Competitions Administrator “possibly failed to recognize or address” that WPX youth players were playing for LHCAFC, is unsound. We think the onus is on clubs to ensure their players are eligible to play and that it would set a bad precedent for it to be a defence to playing ineligible players to be able to assert that Capital Football should have identified the ineligibility before the match took place.
Capital Football acknowledge that this process has had a significant impact on all clubs involved and understand that it is an unfortunate way to end the season. We are very conscious of the importance of this dispute and what it means for two of our member clubs, quite apart from LHCAFC and WPX. But we believe for the integrity of our competitions the NZF DC decision should be taken on appeal. We will do all we can to expedite a hearing of the appeal.

Yes that’s pretty much explains it and it also explains significant inconsistencies.
I hope someone has extensively checked Comet/Records to definately establish that no ineligible player was involved in either of the 2 x IBU/LH games !...Now that would be a plot twist ;-)
What it will mean is that IB will win the league and go to the play-off. Seatoun will drop to 9th in the league via losing the 3pts they were awarded and goals.
Interesting to see the Participation Agreement mentioned here. My best guess is that CF gave some kind of blanket dispensation for Phoenix players (or Phoenix thought they did) but players are actually registered for LHC so it didn't apply. Hope we get the whole story at some stage.

I think it's interestingt that there was a distinction where LHC players could enter the NZF cup competition, but not Phoenix reserve players. Clearly even in NZF eyes, there is a difference between the two entities.
This is me coming to the party late. But is it over them playing someone who is to young? That they didn't have dispensation to do??

That’s right. Lower Hutt appealed the initial decision by Capital Football which CF upheld and then they appealed to NZF who overturned the CF decision. I also understand there was no initial complaint by any club that sparked the review, it just that CF became aware there was an issue and investigated it under its own steam.
Capital Football would like to provide an update to clubs regarding the dispensation regulation breach by Lower Hutt City AFC (LHCAFC). See previous communications on this subject HERE.
As communicated on Friday 2 September Capital Football decided to appeal the New Zealand Football Disciplinary Committee (NZFDC) ruling to the New Zealand Football Appeals Committee (NZFAC). The NZFAC carried out the appeal process over the course of the week which included detailed submissions from both Capital Football and LHCAFC.
The NZFAC have decided to uphold the appeal made by Capital Football and therefore supports the original decision made by the Capital Football Competitions Administrator. For clarity, the sanctions imposed on LHCAFC and the points deducted will stand.
Please note, that it is stated in the NZ Football Disciplinary Code, that this decision can be further appealed to the Sports Tribunal NZ or the Court of Arbitration for Sport (CAS) in Lausanne, Switzerland, as specified in the NZF Statutes.
Capital Football are currently working through the next steps following receiving this decision. Given the number of variables involved, we will take some time to work with all parties before sending out further communications early next week to clubs. This will include details of final league tables and the Central League playoff fixtures.

Capital Football is now in a position to confirm the final league tables for Capital Premier and Capital 1, as well as the Central League Playoff fixtures following the dispensation regulation breach by Lower Hutt City AFC (LHCAFC).
The decision from the New Zealand Football Appeals Committee (NZFAC) was communicated on Friday 9 September, stating that the NZFAC decided to uphold the appeal made by Capital Football and therefore support the original decision made by the Capital Football Competitions Administrator. LHCAFC have confirmed that the club will not be appealing this decision to the Sports Tribunal NZ.
The Central League Playoff fixtures are confirmed and scheduled as below:
