How is some guy running some random website in a random country going to know more than the Phoenix or anyone else associated with football in NZ about the status of Michael McGlinchey. He has found a story and latched onto it.

If the information actually comes from the FIFA transfer matching system, to which you can subscribe, then it requires "both" clubs to have official signed off. I don't know whether that is from there or not. This is additionally confusing however as there are three clubs, plus possibly the FFA, involved.

Given that the only source for this rumour as far as I can tell is "some guy on Facebook", I doubt that it's true.

I saw him. He spent 3/4 of the game about 3m away from me

You resisted the temptation to ask him about his contractual status AJ? ;)

AJ13 - "some guy on Facebook"

Were you tempted to speak with him, I probably would have asked when training starts

Edit, that guy on YF beat me to it

Heard a few people around me talking about him loud enough for him to hear (he would look around when his name was mentioned). I didn't want to be that guy and invade on him by asking in front of everyone. I'd rather read all the speculation in this thread

With the Salties trumpeting that they've resigned Storm Roux, perhaps they're softening their fans up for the bad news (for them, GREAT news for us).

CCM Fans in the same boat just on the other side:

n the last few weeks especially against Adelaide and Wanderers we were accused of being too defensive and playing five at the back. I think that it was actually very good tactic and was essentially very attractive when we weren't continually fouled. We used this against Brisbane I think lining up from DM as

---------------Monty
------Caceres----------Hutch
Bernie------Duke-----------Fitz

This team was exceptionally quick on counter and created plenty of chances and looked at that stage ready to challenge for the title.

Against Adelaide we lined up in a similar way and didn't seem as fluid. This was caused by Gombau instructing his play to foul our guys on the break. This resulted in 4 yellows against Adelaide by half -time. When they weren't able to foul with impunity in the second half we looked better and went on to win. This game we were pilloried for playing negative football - but it was Gombau's tactics that caused us to look negative in the first half. Wanderers applied the same tactics the following week but the referee turned a blind eye to their consistent fouling.

I actually think Mossy was trying to emulate the Liverpool front 6 from last year

---------------Gerrard
------Coutinho----------Henderson
Sterling-----Sturridge------Suarez

This year with Wee-Mac hopefully back and a possible further attacker

---------------Monty
------Caceres----------Hutch
Bernie------Duke-----------Fitz

will morph into something like

-------------------------Monty
-----------Caceres-----------------Wee-Mac
Duke/new
fast winger---------Duke/new No 9------Fitz

To use Australian players as an example the fast winger would be similar to Ruka or a new No 9 in the mould of Richard Porta

I love how aussies always reference Richard Porta when none of them have seen him play and he's now knocking around in some oil league

Oh dear, this really is going to turn into a bun fight, just because some village idiot in the FFA released something they shouldn't have.  I think the FFA owe us big time on that and should back the club (The Phoenix) and Wee Mac.

Two big words Nix "Train" CCM "Play"

This needed a nudge to resolve.  Who holds his contract?

That is the problem. CCM thinks he is still contracted but Wee Mac obviously doesn't think he is.

Does he even have a contract? That's the thing, is his old contract still valid or not?

Offered a contract when the ownership changed. Never signed it.

Understand he may have signalled or signed a letter of intent to sign a contract.

I would really appreciate some insight, by those well-read in Australian or NZ contract law, whether "letters of intent to sign" are enforceable in any way.

I still do not see this ending well for the Phoenix (as much as I would like it to do so)

Yeah I hope we aren't betting everything on him being available. There needs to be a plan b (perhaps Burns taking up that role?)

It'll be enforceable in theory but will come down to what the actual content of the letter is. Then of course there are pragmatic considerations as to whether it's worth a shitfight over. Although it would seem that CCM are up for a shitfight at this stage.

Surely CCM wouldn't want someone playing for them who doesn't want to be there. It isn't exactly a great look for the club.

My thoughts exactly. It's not exactly great for team morale is it? Unless they are hoping to sell him overseas and collect some cash for him.

Worked out alright for Liverpool last season.

Surely it's clear to CCM that Wee Mac does not want to be with them. They can't get a transfer fee from us so if they 'win' the dispute they are gonna end up having a player that does not want to be at the club. Is that really what the CCM coaches and fans want? I've always been of the opinion that if a player didn't want to be at the club then I didn't want them either (i.e Carlos)

EDIT: Took so long writing this that someone above already mentioned the same idea

Alot will depend where the PFA stand.  The FFA have always bent over and taken it from the PFA.

Usually the PFA would be in a position where they want to help the player by making sure his old contract is still valid, but in this case that isn't what the player wants. So there's not really a precident for them to base their decision on, lets just hope they side with the player in this case.

You would imagine an association established to look after the players would generally side with the player if they had some legal grounding.
