BIG BAD (AND NOW BANNED) T SHIRT

Maybe the All Whites Coach should have a word with him about the benefits of allowing your face to be used on t shirts that football supporters wear?!?

Apparently I'm apathetic, but I couldn't care less.

Have had to think pretty carefully about posting this, but I figure you're all big kids so why not keep you in the loop.

Rory Fallon has demanded, through his agent Neil Sang, that we remove the Big Bad t shirt from sale or do a deal to pay Rory some money for them.

We're in discussions. We don't believe we've done anything wrong but of course we're conscious of not wanting to upset one of the All Whites' big boys.

If we can resolve things Big Bad will go back on sale, if not it will be a very limited edition collector's item!

(By the way: see the sh1t we have to deal with!!!)

While I can (kind) of understand where he is coming from (his likeness, he should benefit) you'd hope that the context might make him change his mind.

Suing your own fans is never much of a good idea...

Yeah the context is what makes this move by him terrible in my eyes, and makes my respect for him go way down. Its not like its someone profiting from his image at all,it goes toward (i would hope ) running one of the very few (if not the only) decent football fan clubs in NZ. Which you would think he would want to encourage, not try to profit from himself.

Tell him that some of the profits will go to the local church group/ generally will be used to encourage more praising of Jebus and I'm sure he'll come around.

I'm sure the fever can count as a church group since Jesus Bertos gave hm that chance he was preying for.

I still think it was his agent. All he'd have to do is google "Rory Fallon" (as any good agent would from time to time) in the past 4-5 weeks and he would have found his clients image in merchandise.

Its no longer a problem.

His agent probably just advised against setting a precedent.  While I'm not an expert, it seems likely that ignoring this use of his likeness would tend to weaken potential suits against bigger infringements.

Can't imagine there's much of a clamour to use pictures of Rory Fallon in too many places to be honest.

Someone on here or maybe Ricki should have a word to Rory because this is becoming a complete joke.

Actually, in the real world it's kind of discourteous to simply use someones image without asking them. A simple inquiry before printing a whole lot of t-shirts would have been sensible maybe?

It might seem a bit off from our side of the world but in the UK this kind of thing is a massive problem. You can't move outside a football match without some dodgy geezer trying to sell you some piece of cack rip-off t-shirt or souvenir.

Anyway, who took the photo? For example, if the photo is one of these then it actually belongs to Getty Images and is for them to license.

I understand that few get rich playing for Plymouth Argyle, but really, will an 'agreement' with White Noise swell the coffers any much further?HarryHotspur2009-12-15 20:55:38

Don't hate the player, hate the game!

I think you're being a bit unfair on Fallon. Just because it's Yellow Fever doing it doesn't make it right, especially when all somebody had to do was ask first and the whole problem could have been avoided.

By the way, you try making a-shirt with the Phoenix logo or even the words "Wellington Phoenix FC" on it without the club's permission and see how fast your beloved Tony P comes down on you...

Over all I'm pretty annoyed about this, it could well have been Kevin Fallon who mentioned it to him. Maybe he took offense to it?

The word Phoenix isn't copyrighted. So it's fine to use. The name "Wellington Phoenix FC" and the logo are. So they're off limits.

Ricki gave his blessing to YF before the Retro Rickis were made IIRC

So I take it no-one gives a f**k if I start making my own range of Yellow Fever t-shirts and selling them around town then?

Quite few of you have photos in the galleries on this website. I think I'll use those. Don't worry, I won't make any money out of it, just cover my costs.

I'll mock some up over the next few days and post them hear first. Not that I need your permission of course.

Perhaps

One thing I'm unsure on though is - does Rory even know about this? His agent is hired to take care of all the little things he'd be too busy to take care of, and while hopefully he'd be kept in the loop, I'd imagine a professional footballer to be too busy to be consulted on every minor decision made by their agent. This might be an industry standard procedure caused by the aforementioned dodgy merchandise, so standard that an agent might not even think to mention it to his player.

I don't know the full story but I do wonder if this might be the case, and thus it may be too early to rubbish Rory.

(Oh, and if they cannot go back on sale, I vote to send tomrewi a freebie. Postage aside, it's not like you'd lose any more money, and the bloke deserves one!)
