It's worth remembering that CCM weren't even expecting WeeMac back until after the J-League finishes in December.

Also, if he only agreed to quit his loan in Japan because he had been advised he would be a free agent and able to pick up a paying gig somewhere then he has every right to be pissed. Why else would he do that? At least he would have been getting paid, training and possibly playing.

For me the clincher is the fact that McGlinchey wants to play for the Phoenix.  They can go through all the legal arguments they want but at the end of the day do CCM really want a player that doesn't want to be there?

Sometimes these things become "a matter of principle" and to a degree I can see why they would not let a player go for that reason alone.

the club is owned by a big swinging dick

and big swinging dicks tend to have egos and take offense to being dicked around

they play hardball

you don't want to encourage players to think they can breach contracts and piss off when they like.  sometimes you may decide to take a stand

My theory:

CCM screwed up royally. Trying to get a new team to cover their backsides. Being massive dicks until they have. FFA are supporting them being massive dicks. Screwing us out of seeing WeeMac, Gorrin and Riera play together against Newcastle. so =======>screw them!

CCM used to be a class club. Now they are Perf II.

The loan agreement is going to be interesting. 'Cos of how it could be terminated. If WeeMac was let go, but was unable to go back to CC...anyway...

WANT-away midfielder Michael McGlinchey’s contract saga has exposed an ownership debacle at the Central Coast Mariners.

McGlinchey has been caught in a tug of war between the Mariners and the Wellington Phoenix since returning early from his loan spell with Japanese side Vegalta Sendai in June.

The New Zealand international believes he is a free agent, while the Mariners claim he is contracted to the club until January.

The Daily Telegraph can reveal the confusion stems from the sale of the Mariners in April last year from previous chairman Peter Turnbull, to the club’s current owner Michael Charlesworth.

Contracted Mariners players were asked to sign an agreement acknowledging the change of ownership, but by the time the document was drafted, McGlinchey was already in Japan and did not sign it.

McGlinchey’s camp insist that proves the New Zealander is a free agent, but the Mariners have continued to fight the claim.

With McGlinchey’s case now in arbitration, sources have indicated Charlesworth and Mariners CEO Bruce Stalder approached the players last week asking them to sign yet another agreement, this time stating that ownership of the club was, in fact, never transferred.

Before Charlesworth took over full ownership of the club he was already an investor, so Football Federation Australia insist they have no concerns over which company holds the license.

But current Mariners players are understood to be confused about which company they are contracted to and many of them have been advised by their agents not to sign anything until the situation is resolved.

“There is no concern about the ownership of Central Coast Mariners, or player contracts,” an FFA spokesman said.

“This is simply a transfer from one Mike Charlesworth company to another Mike Charlesworth company. There is some paperwork to be finalised by the club, which should be completed in the coming days”.

The Professional Footballers Australia has been working with the Mariners this week and the players were briefed by the club yesterday.

Charlesworth, who is overseas, was unavailable for comment.

Meanwhile, McGlinchey was prevented from playing for the Phoenix against English Premier League club West Ham in New Zealand on Wednesday night, leaving Wellington coach Ernie Merrick “appalled” by the saga.

“To leave him in limbo for this long is totally out of order,’' Merrick said. “I’m hugely disappointed.”

Initially scheduled to take part in the game, McGlinchey was pulled from the line-up 15 minutes before the game was due to kick off

The PFA, through their lawyers, has already advised McGlinchey that he is free to sign for Wellington and a resolution is expected shortly.

if weemac is forced to stay could he force through a season loan to us or will he just pull a tevez/play very average for mariners.

Problem may go away by itself ... BTW congs on signing that Dutch Kid...if the Seip transfer goes tho and we sign another couple of players then the issue will solve itself ... TBH the way the article reads the Mariners took what should have been quite a simple thing and made it very complex...

If the FFA and club claim that there was no actual change of ownership then why get any players to sign anything? Wouldn't you just assume everything stays as is. By getting players to sign something which acknowledges a change of ownership in whatever form, aren't you admitting that something's changed? Therefore, if a player doesn't sign that document he's not in the same position as a player who has signed it. Or else why have them sign anything?

This may be a too a simplistic idea but what if CCM effectively agreed to loan Wee Mac to us until 1 January and write into the contract that he can't play against CCM for the 18th October and 13 December games.

Better than forcing a player to play form them who doesn't want to be there.

Although a true professional CCM would have to ask, is he giving his all? On that point alone, they should just release him, not that they have a contract with him.

Mercifully, the Michael McGlinchey mess is set to be resolved by the end of the week as an independent arbitrator prepares to make a ruling on whether the All Whites midfielder is contracted to the Phoenix or Central Coast Mariners.

He doesn't state his own sauce unfortunately.
