that's worst case scenario, Fifa could well and truely stuff it all up for us the AW's which would suck for Dura. I don't think we lose a lot at CB though if he isn't eligable.

I guess one point is that he was with the Phoenix for 5 consecutive seasons, and the loan only covered a section of pre-season training, while he was still a member of the club in New Zealand. He didn't change clubs for any A-league season. That is a bit like saying having the pre-season trip to India could be considered leaving the country...At least I hope this is the line of argument that works!!

Ah, no, it's more like saying that quitting your job and taking up a job in India for a while could be considered leaving the country. Quite different than a pre-season trip.

My understanding is that A-league clubs are not allowed to directly buy/sell/loan players to another A-league team. I believe this is due to FFA's desire to prevent higher reputation and more financially wealthy teams from poaching players from smaller clubs part way through a season. For example, this stops a club like Melbourne Victory buying a player like Andrew Durante for a transfer fee (say $150,000 - which is entirely feasible for a club like MV) even though he is contracted for several more years at the Phoenix. I guess the aim with this objective is to maintain the competitiveness and relative stability within the playing field. This is beneficial for newly established clubs as they don't have the traditional structures and fanbases - foundations which can take a long time to form. Therefore, the FFA does not want to alienate a set of supporters whose team is losing week in and week out to bigger clubs for more financial power. It's all about maintaining the stability of the league, which is also why there is a salary cap. If there was no salary cap, the Melbourne Victory and Sydney teams would probably be the only teams competing for the title every year. 
To get around this problem of no loans or transfers, I understand that the Nix temporarily released Durante from his contract so he was a free agent. This allowed Sydney FC so sign him as a free transfer which means that technically, he was living in Australia and working in Australia with no ties to New Zealand for this time period. The difference between this situation and the Indian pre-season tour is that he was still contracted and working for a New Zealand club during his tour of India. 
I have a feeling that he won't be eligible, we will lose those 3-points, and a fine could come our way. IMO it was a pretty dumb decision to play Durante without solid confirmation from Fifa in the first place. If we get a fine, it's deserved.

I think that's a bit rough. If FIFA were non-committal and said it is up to you then what choice did we have? We wanted a clear and definitive decision so had to force them into it. The decision wasn't dumb. The lack of one by FIFA is the true issue IMO

Even if he was playing in aussie for that three months he was resident in NZ - he may have stayed in aussie for that time but I bet you he was being paid into huis NZ bank accounts, his mail came here etc - surely that has to count.

Like we've already said, 'continuous residence' does not necessarily entail continuous physical presence, so NZF will have to make strong argument along those lines to FIFA.

I'm not sure if this has ever happened before, which is why FIFA may have been a bit reluctant to make a swift ruling.

Actually we had a lot of choice. We did not need to play Durante at all. We could have quite easily have waited for a firm decision. In hindsight it seems there was something up, on FIFAs side, if they did not go ahead and confirm what looked like a routine matter. What harm would there nave been in waiting ?

It had to be a competitive game. The Solomon Island game was our only throwaway game to force a ruling from. We were never going to risk the play off games or the World Cup if we make it.

I guess you can think of it as NZF being willing to gamble whatever the amount of the fine is, with the prize being that he is available to help us qualify for (and potentially play in) the world cup. 

Sounds fair to me, depending on the fine.

The harm in waiting would have been FIFA not making a decision either way until forced, and us being left in November still not knowing for certain of his eligibility for the playoffs and not being able to play him.

This. A firm decision was never coming. NZF have followed the right process here up until this point and assuming they are reasonably diligent in presenting their case then I have no major issue, regardless of the outcome.
