You can't have one rule for Seip and one rule for McGlinchey just because "everybody's happy". And whilst I am not a Lawyer, I did top Business Law when I did my accounting degree. I also topped Trustee Law in NZ and Australia. The reason this has gone on for so long is the Mediator (who may be more familiar with International Law) and FFA don't want to set future unintended consequences (read "shit").  This is however no excuse to hang Michael McGlinchey out to dry, whatever they think of him " taking advantage" of a legal loophole.  The powers that be are just being bastards because his circumstances have put them in a sticky situation. Someone needs to "man up" here.

When I watched the Magna Carta being signed I remember one bit about "Justice delayed is Justice denied". There was also some stuff about every person having the right to work in their chosen profession........shame.

From the Magna Carta as Sellar and Yeatman (1930) state:

So that's the answer. Finally a legal explanation I can understand.

As WeeMac and all us Nix supporters are all "common people" (aka NZ'ers) 

then the FFA is using the Magna Carta to tell us to go get f**ked.

This is beyond a joke... how long have we been hearing this will be decided soon...

maybe we should 'let CCM have him'  and keep paying him under the table. We already know (or think we do) that they dont have cap space, so we could then 

A) lay a comkplaint with the FFA that they are over the cap, 

B) If they dont pay him till Jan he could take them to court and get a release, then sign for us

or C) if the first 2 don't work stink it up for them so bad that they will want to get rid of him.

Reading the PFA statement, this seems to be the reason and the problem.

“However, it only recently emerged that the entity licensed to operate the Mariners had not changed, but will do so in the near future. The reason for the failure to transfer the licence has not been satisfactorily explained to the PFA.

So McGlinchey doesn't have a license with the new CCM legal entuty, but FFA haven't changed over the license from the old entity to the new one yet.

So at the point the licence does transfer do we run into the same problem again? from reading that, its sounds like that decision was come to purely because the company with which McGlinchey has the contract is still the holders of the A-league licence, but not for much longer.

This sets a extremely dangerous precedence if that happens. Essentially, would that then mean (if the licence change hasn't happened by the start of the season) that CCM players are not being paid by the licensed owner (Previous owner). And that could therefore be a breach of contract, and in McG case, as he has not signed a contract to reflect this (Who knows what are in those contracts that they signed months ago), he could therefore take them to court (If he so wanted). 

One thing we all know, he won't be signing any contracts that have CCM on it thats for sure.
