For me, the broader issue is that - no matter if the loan from WGA comes through, whether Terry has his companies liquidated or not - you are very unlikely to have a stadium full of people chanting "We love you Terry, we do" again. Which is probably "mission accomplished" for the people who started the media campaign after The Apprentice.

It's actually a better model for us in this situation, which may allow for a rescue if there are interested parties, and would preserve player deals etc?
I'm sure NQ Fury felt the same way...

I have an idea of how things will go if someone else takes the club over...
A customer enters a pet shop.
Mr. Praline: 'Ello, I wish to register a complaint.
(The owner does not respond.)
Mr. Praline: 'Ello, Miss?
Owner: What do you mean "miss"?
Mr. Praline: I'm sorry, I have a cold. I wish to make a complaint!
Owner: We're closin' for lunch.
Mr. Praline: Never mind that, my lad. I wish to complain about this phoenix what I purchased not half an hour ago from this very boutique.
Owner: Oh yes, the, uh, the Wellington FC...What's,uh...What's wrong with it?
Mr. Praline: I'll tell you what's wrong with it, my lad. 'E's dead, that's what's wrong with it!
Owner: No, no, 'e's uh,...he's resting.
Mr. Praline: Look, matey, I know a dead phoenix when I see one, and I'm looking at one right now.
Owner: No no he's not dead, he's, he's restin'! Remarkable club, the Wellington FC, idnit, ay? Beautiful plumage!
Mr. Praline: The plumage don't enter into it. It's stone dead.
Owner: Nononono, no, no! 'E's resting!
Mr. Praline: All right then, if he's restin', I'll wake him up! (shouting at the cage) 'Ello, Mister Polly Phoenix! I've got a lovely fresh cuttle fish for you if you show...
(owner hits the cage)
Owner: There, he moved!
Mr. Praline: No, he didn't, that was you hitting the cage!
Owner: I never!!
Mr. Praline: Yes, you did!
Owner: I never, never did anything...
Mr. Praline: (yelling and hitting the cage repeatedly) 'ELLO POLLY!!!!! Testing! Testing! Testing! Testing! This is your nine o'clock alarm call!
(Takes phoenix out of the cage and thumps its head on the counter. Throws it up in the air and watches it plummet to the floor.)
Mr. Praline: Now that's what I call a dead phoenix.
Owner: No, no.....No, 'e's stunned!
Mr. Praline: STUNNED?!?
Owner: Yeah! You stunned him, just as he was wakin' up! Wellington FCs stun easily, major.
Mr. Praline: Um...now look...now look, mate, I've definitely 'ad enough of this. That phoenix is definitely deceased, and when I purchased it not 'alf an hour ago, you assured me that its total lack of movement was due to it bein' tired and shagged out following a prolonged squawk.
Owner: Well, he's...he's, ah...probably pining for the fjords.
Mr. Praline: PININ' for the FJORDS?!?!?!? What kind of talk is that?, look, why did he fall flat on his back the moment I got 'im home?
Owner: The Wellington FC prefers keepin' on its back! Remarkable club, id'nit, squire? Lovely plumage!
Mr. Praline: Look, I took the liberty of examining that phoenix when I got it home, and I discovered the only reason that it had been sitting on its perch in the first place was that it had been NAILED there.
(pause)
Owner: Well, o'course it was nailed there! If I hadn't nailed that club down, it would have nuzzled up to those bars, bent 'em apart with its beak, and VOOM! Feeweeweewee!
Mr. Praline: "VOOM"?!? Mate, this club wouldn't "voom" if you put four million volts through it! 'E's bleedin' demised!
Owner: No no! 'E's pining!
Mr. Praline: 'E's not pinin'! 'E's passed on! This phoenix is no more! He has ceased to be! 'E's expired and gone to meet 'is maker! 'E's a stiff! Bereft of life, 'e rests in peace! If you hadn't nailed 'im to the perch 'e'd be pushing up the daisies! 'Is metabolic processes are now 'istory! 'E's off the twig! 'E's kicked the bucket, 'e's shuffled off 'is mortal coil, run down the curtain and joined the bleedin' choir invisibile!! THIS IS AN EX-PHOENIX!!
(pause)
Owner: Well, I'd better replace it, then. (he takes a quick peek behind the counter) Sorry squire, I've had a look 'round the back of the shop, and uh, we're right out of phoenixs.
Mr. Praline: I see. I see, I get the picture.
Owner: I got a slug.
(pause)
Mr. Praline: Pray, does it talk?
Owner: Nnnnot really.
Mr. Praline: WELL IT'S HARDLY A BLOODY REPLACEMENT, IS IT?!!???!!?
Owner: N-no, I guess not. (gets ashamed, looks at his feet)
Mr. Praline: Well.
(pause)
Owner: (quietly) D'you.... d'you want to come back to my place?
Mr. Praline: (looks around) Yeah, all right, sure.

How long does it take for the FFA to take back control? Why would the IRD evenmove to liquidate if there are no assets of value? Just to stop it incurring more debt?I'm somewhat surprised NZ law allows this, seems an easy way to bury debt. Still, not going to complain, definately good news for the club.

It's really the only option open to the IRD in these circumstances, but you can see why they have allowed it to run for a while - their only real chance of any significant payment is if Terry finds a way to pay.

I've never read an A League licence agreement but a standard sort of termination clause would be that if either party commits an act equivalent to insolvency (like being liquidated by the courts) then the other party has a right to terminate.

Sorry Smithy, I know you're a lawyer who's very good at what you do, but I will reserve judgment until I hear what AucklandPhoenix has to say about all this.

The FFA have not owned the Roar for the last two years. New owners took it over two years ago with an agreement that they were only in it for two years. Currently they are not owned by the FFA.
Also, how long did it take to replace the Knights? ...and that was a clusterf**k.

The FFA have been very clear that they are keen to have one side in new zealand. Whilst the knights/auckland were a flop in attendances and performances, the Phoenix are not. We are a solid support base for the club and that has been reflected in the teams performance over the last 4 season. The only other place I could see a NZ franchise is Christchurch, and do you really think that is going to happen?

Finals appearances, a place in the hearts of the general populace, a bigger market to sell it in, the current frowth in the game here.
The Phoenix are considered an asset to the city of Wellington and are already entrenched in the city and the nation. Fury never got a chance to do that.

The FFA undoubtedly want one NZ side so they can sell tv rights to Sky, but not at any financial cost.
Otoh, maybe they dumped Fury because they knew they needed to be able to step in in Welly. Although i still think proping us up will make the FFA very unpopular.

In the eyes of the convict side, Would you expect the Australian public to go for that, That a kiwi team can be help up by the FFA and yet a Aussie side cant?. It would be course a major stink. The Phoenix are considered an asset to the city of Wellington and are already entrenched in the city and the nation. Fury never got a chance to do that.

Its also been mentioned that without a NZ side in the competition, sky would be very disinterested in screening A league games here.
Thats a whole country of potential viewers lost.
Its in the FFAs interest that a NZ side is succesful.
On the other hand, the FFA propping up a NZ side would cause a bit of an uproar. I imagine they'd just ignore that, but any potential funding wouldn't last too long.

I've always thought this was a genuine possibility - the FFA propping up the Nix until someone could be found to take over - but in light of the plug being pulled on the Fury I think it's actually very unlikely.
I'm also told that there are obligations that the FFA have to Fox to make sure there are teams in major Australian capital cities.
Townsville is not one of those, and neither is Wellington.
So I think for the FFA it might come down to a calculation of whether what Sky are willing to contribute to the pot is enough to make the Phoenix a worthwhile investment.
We all know what Sky's history is like in regards to supporting football.
So, I now think it very unlikely that the FFA will prop the Nix up. Maybe in the very short term to see if a new owner can be found, but certainly not through the next season.
I hope I'm wrong though.

What is the NBR's agenda? If Terry gets liquidated, and if Ali Syed is a crook, no-one gets paid. Nippert's twitter certainly suggests he's just in it for the thrill of "taking down" a really big fish.Doloras2011-03-07 15:11:16

Thank you Nostradamus.
We all know that Terry has many enemies, partly because of his business practices, partly just because "his face doesn't fit" among the NBR-reading crowd. Add to that the nastier section of the rugby tragics, and you have quite a large market who really, really want Terry and the Nix to fail. And they buy papers, and clog up comments boxes on websites.Doloras2011-03-07 15:18:09

I don't much like it either, Doloras, but i actually found the Serepisos positioning on it in court interesting.
Specifically i mean:
"Terry Serepisos' main defence this morning was an affadivit, signed by himself, claiming a $US100 million loan, understood to be from Western Gulf Advisory, would soon arrive to satisfy creditors."
Which was the basis for their bid for a 6 week stay- presumably for time to explore other refinancing.

If it all goes tits up this week we should be erecting a f**king statue of Terry because it will mean that he actually crucified himself for the Phoenix. OK, so he may have got in touble anyway (without the Phoenix), but the amount of money he's put in to the Nix would surely have helped prolonged the life of some of his other interests.
Despite everything he's ever said about being into the Nix for the long term I never actually believed he would let it get so far as f**king up his core businesses. That's why a small part of me still thinks he has a way out of this.
And if it really is over, then he is a legend. A stupid f**king idiot of a legend, but still a legend.
