He made those statements in the appeal didnt he?

Surely that would constitute him receiving the original ban.  Really clearly lying while trying to appeal should be a solid red, and maybe earn another game ban.  Dura wasn't close enough to be choking him stopping him speaking to a doctor.

There were plenty of people there though, surely there would be witnesses to that? In the ruling they said that they couldn't confirm that Durante choked Berisha, but surely someone else there (like the MV dr or the ref) would see that and could either say it did or did not happen.

The question I would ask is this:

The referee was there for pretty much the whole time. If Durante was choking him as claimed, then surely he would have gotten a red card as well and it would have been seen? If he had done that, would it not have provoked an incensory reaction from Berisha about it and also other Victory players?

And if it really happened, but "wasnt seen", then technically it should've also been reviewed by the panel, and Durante should be getting a ban for it now, right?

      "The A-League's independent disciplinary committee upheld the Victory's appeal against their star striker's additional one-game ban after he was sent off against Wellington Phoenix in their second last game of the season.

      They found that Berisha missing half the Phoenix game and being suspended for the final round was a sufficient penalty, but he was warned not to appear before the tribunal again.

      Victory's lawyers, led by Christopher Townshend QC, produced a series of still photos of the seconds before the incident. These proved persuasive to the panel.

      The photos showed Durante's hand reaching out to Berisha while he was on the ground. This footage was not shown clearly during the television broadcast.

      Berisha also contended he had not made contact with his studs but had brushed Durante's leg with his "outside shin" in an attempt to move Durante away from him.

      Berisha told the committee that Durante had put his boot under his ribs and his hand on his throat while he lay on the ground. He was being treated by team medical staff

      after being felled by a forearm to the head during an aerial contest with Wellington's Ben Sigmund.

      "He had his hand on my throat and I couldn't speak," Berisha told the committee.

      "(At the same time) He was saying 'stay calm'."

      Berisha said he had a concussion test at half-time and after the game.

      "My head didn't stop hurting until the next day," Berisha said.

      Berisha told the tribunal Durante had a history of attempting to provoke him."

      Will these surface ?

      I know this wont be popular here but  Durante shouldnt have been in there there, the guy (yes that idiot Berisha) was being treated for a knock to the head

Dura shouldn't have been there but that should have no influence on the length of ban Berisha gets for his actions unless for the first time in history provocation is now a defence for violent conduct.

given Kevin Muscats record as a violent thug of a player I therefore sent my side out to kick the living shark out of anything moving in a blue shirt. 

I would like the suspensions handed out to my players to be offset by these circumstances.

Of course Dura shouldn't have been there, and the Ref should have told him the fek off. But Berisha was fairly obviously hamming it up, nobody rolls around on the ground like that rubbing their head if they are injured like that. They lie pretty still and hold the injured part.

Why are you guys all so mad? How have you been put out by this? I can't see how it's anything for you all to get so worked up about. He got a red on the day, and missed the following week. All this talk of retribution and legal recompense is ludicrous.

Yet he still flew out to Korea that day for their ACL game. Surely if his head is still sore the next day he should be having at least a week off to recover from the concussion, not flying to another continent to play a game 4 days later

Victory fans may not care about their players and lies being peddled about then but we do.

Also the way bans are handled are relevant to all teams.

If Bes's testimony led to Durante copping weeks, then I'd understand the vitriol. Hell, I'd join in, as that would be an absolute dog act. But it didn't.

It was the testimony of a man who lives to win, to play in big games and hold up trophies. You can call him a cheat and a thug (ignoring the fact that he was the one who was elbowed in the head) and maybe he his all that. But he's also a total warrior who would do anything to win. His passion is infectious. It's why we love him.

Not that I care about our players, mind you ;)

It's because behavior like his really holds up the sport in this country and should be stamped out completely rather than have leniency shown. I don't care from the Phoenix POV,I just care because I'm sick of potential fans being put off.

You can't just make allegations like he did when there are witnesses and video evidence to the contrary and not expect to be reprimanded, it sets a horrible precedent.

He's also not a warrior, he's a diving wimp weeks a complete embarrassment.

The fact that it didn't just shows how the process has been completely undermined here - purely in order to allow one of the A-League's best players to participate in the finals, thus improving the quality on the pitch at the expense of the actual rules of the league. That's why the FFA are a weak pack of starf__kers in my opinion. Excuse the language but that's the best word for it I feel.

Saddest thing is that the ref got it absolutely spot on in the heat of the moment - Dura shouldn't have gone over there, so yellow for him. Berisha shouldn't have reacted violently, so red for him. 100% correct decision. 

This upheld appeal has left those cards as they were, but reduced the ban for the red, effectively rendering the actual rules of the game meaningless. A violent red is supposed to be a 2 match ban, end of. 

If they are now saying that that is up for negotiation it sets a worrying precedent.

I suppose it is strange that followers of the game would be concerned about whether the disciplinary system operates in a fair, unbiased, and reasonable manner
