You guys need to have the push and pull like the NZRU and lobby to have the taxpayers to pay for any shortfalls. The 2011 Rugby World Cup is expected to lose over 500 milliona dn John Key's government is happy to underwrite not with his money, but with taxpayers' (including yours) money. This way, your soccer future will be secure and your Wellington Phoenix will be safe.

Without getting over technical it may be impossible for that to happen in the open now. 

 

To explain�the funding of the Nix by Terry can only take one of three forms, first share capital, second a loan, and third as an expense to one of his other companies as the sponsor of the Nix�

 

Lest look at each of these � As share capital it is perfect Terry can sell the Nix for whatever price he can get and put these funds into his general holdings�

 

As a loan, meaning whoever buys the Nixs owes Terry companies these loans, and if Terries  companies go belly up the creditors will come chasing these loans� Because of claw back laws Terry is in no position to write these off � meaning no buyer would want the Nixs if the funding of the Nix has been by way of loans from Terries companies� 

 

As an expense, this assumes that Terries companies have written off in their books as an expense the cost of running the Nix� my guess is this has not happened as Terry would not have wanted to increase his consolidated losses�.However if Terries companies had written these off as expenses then there is no issue in selling the Nix� 

 

Nobody on the forum would I assume have any knowledge of how the funding was undertaken. My guess is only Terry and his Accountant know �

 

But if by way of a loan [which is my guess] � which does not increase his companies losses and would show a tangible asset being able to be collected then no one will go near the Nix until they are taken out of Terries hand and the licence given back to FFA�

Midfielder you're probably right that the Nix are funded through shareholder loan.  However, as JD has explained elsewhere in this thread, the licence could be transferred without the company. Terry's financial situation is not an impediement to a new owner.

The numbers are the company numbers assigned by the NZ Companies Office when company is approved by the Registrar of Companies  (incorporated).

Richard Burrell is another not so well known developer round town, now owns a few storage facilities and other things, hes also had his run ins with liquidators too in his time thru various companies hes owned. Probably a mate of the reporter bit like the punch up story.

Full story to the above. Terry appears to have struck a deal with FM Custodians, whom people on this thread were confidently predicting were going to put him out of business. I knew he'd shimmy and weave his way out of it, and I am confident that he'll do the same with the other people after him whom the article mentions.

Terry Serepisos has avoided bankruptcy � again.

 

The embattled Wellington property developer looks to have come to an agreement with FM Custodians, who had sought to bankrupt him over personal guarantees he made on loans to two of his companies, New Millennium Design and Century City Developments.

NBR understands the initial loans were for about $6 million, about $5 million of which was still owed.

Associate Judge David Gendall was told in the Wellington High Court this morning that both parties sought an adjournment to this Friday, August 19, as an agreement for payment had been reached at 9.30am this morning.

However, due to the timing of the agreement, and that one of FM Custodians' lawyers was caught in snow in Christchurch, it had not been finalised.

Lawyers for South Canterbury Finance, which joined the proceedings last month as a supporting creditor, supported the proposal.

Associate Judge Gendall granted the adjournment to review the position regarding settlement.

For me the issue of Terry's business and the future of the Nix are becoming less of an issue. I am more confident than I was 6 months ago that the Nix will survive.
 
The reason?....well the Nix are not acting like a club thats about to fall over due to lack of money. You don't start recruiting guys of Mehmet's standing if you have no money. Guys like him are not cheap. Plus everything else about the club and its preseason activity suggest it is business as usual.
 
How this is all being financed? buggered if I know! but somehow the bills are being paid. Maybe Terry made $10 million from the sale of the Tory St business's maybe NZF and or FFA are chipping in, maybe as John Morrison has suggested their are a few generous Wellington businessmen who have donated money.......it could be a bit of all of this.
 
But the bottom line is the club will kick off the next season with a full squad including some useful new recruits....then it will be great to consign this topic to the bin and concentrate on football!!

Not exactly related but I'm going to give kudos to Terry for working really hard to stay afloat. No arguement that he owes a hell of a lot of money around the show but he is paying things off by all accounts. How many of these big guns have just folded their tents when things have got tough and left investors etc holding their dicks? Good on you Tel.
